Terms of Service
Effective Date: May 21, 2026
Welcome to AudioHaven. These Terms of Service ("Terms") govern your access to and use of the AudioHaven mobile applications for iOS and Android, our websites, and any related services (collectively, the "Service"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
AudioHaven is an audiobook and podcast listening platform with content filtering, allowing users to customize their listening experience by automatically skipping content based on user-selected filter preferences.
1. Eligibility
You must be at least 13 years of age to use the Service. This minimum age applies to every account, including managed "child" accounts within a household. If you are between 13 and 17, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. By using the Service, you represent and warrant that you meet these eligibility requirements.
A parent or legal guardian with a Family plan may create and manage "child" accounts for members of their household who are 13 or older (see Section 6). The parent or guardian is responsible for those accounts and accepts these Terms on the account holder's behalf. The Service is not intended for children under 13.
2. Account Registration
To access the Service, you must create an account by providing a valid email address and password. You are responsible for:
- Maintaining the confidentiality of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe have been compromised.
3. Service Description
The Service lets you:
- Stream public domain audiobooks (sourced from LibriVox and other public domain sources) and podcasts (accessed from publicly available RSS feeds).
- Import audiobooks you legally own and apply filtering to them, a feature we call "Bring Your Own Title" (see Section 5).
- Apply content filters that identify and tag segments of audio across categories such as language, violence, sexual content, crude humor, and substance references. When filters are active, flagged segments are automatically skipped during playback.
- Create or join a household to share a library and manage family members and child accounts under a Family plan (see Section 6).
Important limitations:
- Content filtering is provided on a best-effort basis using our content tagging pipeline and human review. No filtering system is 100% accurate, and some content may be missed or incorrectly flagged.
- AudioHaven does not guarantee that all objectionable content will be filtered, nor that all filtered content is objectionable. Filter accuracy may vary by title.
- The availability of filtered titles depends on the progress of our content review process. Not all titles in our library may have filtering available at any given time.
We may change, suspend, or discontinue any part of the Service — including the availability of any title, catalog, or feature — at any time, with or without notice. We are not liable to you for any such change, suspension, or discontinuation.
4. Subscriptions and Pricing
AudioHaven offers a free tier and paid subscriptions:
- Free: a full audiobook and podcast player at no cost.
- Premium: real-time content filtering and related features.
- Family: Premium features for a household of multiple members, with parental controls (see Section 6).
Billing and renewal:
- Paid subscriptions are sold as in-app purchases through the Apple App Store. Payment is charged to your Apple account, and all billing is processed by Apple under its terms — AudioHaven never receives or stores your payment details.
- A paid plan may include a free trial. If you do not cancel before the trial ends, the subscription converts to a paid subscription and you will be charged.
- Subscriptions automatically renew at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period.
- You can manage or cancel your subscription at any time in your Apple account's subscription settings; this is the only way to cancel. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Prices and plan features may change. We will communicate changes to recurring pricing before they take effect, as required by the App Store and applicable law.
- Refunds are handled by Apple under the App Store refund policy. AudioHaven does not separately process payments or issue refunds.
5. Bring Your Own Title
The Service lets you import audiobook files you already own and apply filtering to them ("Bring Your Own Title"). By using this feature:
- You are solely responsible for the audiobooks you import. You represent and warrant that you legally own each file you import or otherwise have the right to use it, and that importing and using it does not infringe anyone's rights or violate any agreement or law.
- You must not import content that is unlawful or infringing, or that you do not have the right to use.
- Imported audio files remain on your device. AudioHaven does not host, stream, or distribute your imported files; we use only file metadata and a content fingerprint to match your file to our filter data.
- AudioHaven is not responsible for imported content, for whether filtering is available or accurate for an imported file, or for any loss of imported files.
- You remain responsible for complying with the terms of the store or source you obtained your audiobook from.
6. Households and Family Plans
A Family plan lets one subscriber (the "household owner") create a household and share access with other members.
- The household owner is responsible for their subscription and billing, for the members they invite, and for use of the Service within their household.
- The owner may create and manage "child" accounts for household members who are 13 or older. The owner controls each child account's settings, approved content, and filter locks, and accepts these Terms and the Privacy Policy on the account holder's behalf.
- Each household member must comply with these Terms. The owner is responsible for ensuring members do so.
- To respect content providers, the number of household members who can listen to the same title at the same time may be limited.
- The owner may change or remove members and roles. Leaving or being removed from a household ends your access to that household's shared library.
7. Beta Features
Parts of the Service are offered on a beta basis, currently including the Android app, which is available through an open beta program on Google Play. Beta platforms and features:
- Are provided "as is" and may contain bugs, errors, or incomplete functionality.
- May be modified, suspended, or discontinued at any time without notice.
- May be offered at no charge during the beta period. Continued access on the same terms is not guaranteed once a beta program ends.
- May be monitored, and we may collect usage data and feedback to improve them.
We will provide reasonable notice before a beta platform transitions to a paid model.
8. User Submissions
The Service lets you submit content such as missing-filter reports, content requests, bug reports, ratings, and support messages ("Submissions").
- You retain ownership of your Submissions. You grant AudioHaven a non-exclusive, worldwide, royalty-free license to use, store, and process your Submissions to operate, improve, support, and secure the Service.
- You are responsible for your Submissions and must not submit anything unlawful, infringing, abusive, or that you do not have the right to share.
- Submissions are not confidential. We are not obligated to act on any request, report, or piece of feedback, and we may use feedback without any obligation to you.
9. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Import, upload, or share any content you do not own or otherwise have the legal right to use.
- Attempt to reverse engineer, decompile, or disassemble the Service or its filtering technology.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorized access to any portion of the Service or any systems or networks connected to the Service.
- Use automated means (bots, scrapers, etc.) to access the Service without our express written permission.
- Circumvent, disable, or otherwise interfere with security-related features of the Service, or misuse household or child-account controls to circumvent another person's settings.
- Share your account credentials with others or allow multiple users to access the Service through a single account, except as expressly permitted by the household features.
10. Intellectual Property
Subject to your compliance with these Terms, AudioHaven grants you a limited, non-exclusive, non-transferable, revocable license to download and use the AudioHaven applications and to access content made available through the Service for your personal, non-commercial use. This license transfers no ownership to you, and all rights not expressly granted are reserved by AudioHaven.
The public domain audiobook content available through AudioHaven is not owned by AudioHaven; its public domain status means it is freely available for use by anyone. Podcasts and other third-party content available through the Service are owned by their respective creators or rights holders, not by AudioHaven.
The following elements are owned by AudioHaven and protected by applicable intellectual property laws:
- The AudioHaven name, logo, and brand assets.
- The AudioHaven applications, source code, and underlying technology.
- Our content filtering data, including segment tags and timestamps.
- The design, layout, and user interface of the Service.
You may not copy, modify, distribute, or create derivative works based on any proprietary elements of the Service without our prior written consent.
If you believe that content available through the Service infringes your copyright or other rights, please contact us at support@audiohaven.app with a description of the work and the allegedly infringing material, and we will review and respond.
11. Privacy
Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your personal information. By using the Service, you consent to the data practices described in the Privacy Policy.
12. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
Without limiting the foregoing, AudioHaven does not warrant that:
- The Service will be uninterrupted, secure, or error-free.
- Content filters will catch all objectionable material or only objectionable material.
- The Service will meet your specific requirements or expectations.
- Any information obtained through the Service will be accurate or reliable.
13. Limitation of Liability
To the maximum extent permitted by law, AudioHaven and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or use, arising out of or related to your use of the Service, whether based on warranty, contract, tort, or any other legal theory.
In no event shall AudioHaven's total liability to you for all claims arising out of or related to the Service exceed the amount you have paid to AudioHaven in the twelve (12) months preceding the claim, or fifty dollars ($50.00), whichever is greater.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.
14. Indemnification
You agree to indemnify, defend, and hold harmless AudioHaven and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of or in any way connected with your access to or use of the Service, content you import or submit, or your violation of these Terms.
15. Termination
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination:
- Your right to use the Service will immediately cease.
- We may delete your account and associated data in accordance with our Privacy Policy.
- Provisions of these Terms that by their nature should survive termination will survive, including Sections 10, 12, 13, 14, and 17.
You may terminate your account at any time by using the account deletion feature within the app or by contacting us. Canceling a paid subscription is handled through your app store account settings, as described in Section 4.
16. Changes to These Terms
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you through the Service or by email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the revised Terms.
17. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Missouri, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in the State of Missouri, and you consent to the personal jurisdiction of such courts.
Any claim arising out of or relating to these Terms or the Service must be filed within one (1) year after the claim arose; otherwise, it is permanently barred, to the extent permitted by applicable law.
18. General Provisions
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and AudioHaven regarding the Service.
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
- Waiver: Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision.
- Assignment: You may not assign or transfer these Terms without our prior written consent. We may assign our rights and obligations without restriction.
- Electronic Communications: You consent to receive communications from us electronically — such as email or notices within the Service — and agree that electronic communications satisfy any legal requirement that a communication be in writing.
19. Apple App Store
The following terms apply when you download or use the AudioHaven iOS app obtained from the Apple App Store (the "App Store Sourced Application"):
- These Terms are entered into between you and AudioHaven only, and not with Apple Inc. ("Apple"). AudioHaven, not Apple, is solely responsible for the App Store Sourced Application and its content.
- Apple has no obligation to furnish any maintenance or support services for the App Store Sourced Application.
- If the App Store Sourced Application fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for it. To the maximum extent permitted by law, Apple has no other warranty obligation whatsoever with respect to the App Store Sourced Application.
- Apple is not responsible for addressing any claims by you or any third party relating to the App Store Sourced Application or your use of it, including product liability claims, claims that it fails to conform to any legal or regulatory requirement, and claims arising under consumer protection or similar legislation.
- Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App Store Sourced Application or your use of it infringes that third party's intellectual property rights.
- You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
- Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
